Terms of Service

These Terms of Service ("Terms") constitute a binding agreement between you and Vision Spy, operator of visionspy.net. By accessing or using the Site or Vision Spy services, you agree to these Terms, our Privacy Policy, and our Security Policy.
1. Agreement
Please read these Terms carefully before using the Site. If you do not agree, you must not access or use our services.

2. Vision Spy service
Vision Spy is a paid enterprise geolocation and visual intelligence service. Access may begin with an evaluation or trial period subject to approval. Continued use requires a valid subscription or service agreement with applicable fees.
The service may be accessed via web interface, API, or other channels we make available. Uploaded images are processed to deliver geolocation results as described in our Privacy Policy.
Analysis results are indicative and must be verified through independent investigation before operational or legal decisions are made.
3. Changes to the Terms
We may modify these Terms to reflect service improvements or legal requirements. We will notify registered users of material changes via the Site or email. If you disagree with updated Terms, you must stop using the service. Continued use after the effective date constitutes acceptance.
4. Privacy
Our Privacy Policy at visionspy.net/privacy describes how we collect and process personal data under the GDPR and Spanish law. It forms an integral part of these Terms.
5. Eligibility and accounts
You represent that you are at least 18 years old and have legal capacity to enter into binding contracts, or that you act on behalf of an organization with authority to bind that entity.
You are responsible for all activity under your account and for ensuring that authorized users within your organization comply with these Terms and our Security Policy.
6. Permitted use
You may use Vision Spy solely for lawful internal business, investigative, or intelligence purposes authorized by your organization and in compliance with all applicable laws, including data protection, export control, and criminal procedure rules where relevant.
7. Prohibited conduct
You agree not to use the Site or services to:
- Infringe intellectual property, privacy, or other rights of third parties.
- Upload unlawful content or images obtained without a valid legal basis.
- Harass, stalk, threaten, or facilitate harm against individuals or property.
- Attempt unauthorized access to accounts, systems, or data.
- Scrape, crawl, reverse engineer, or overload the platform infrastructure.
- Use the service for personal non-authorised purposes or resell access without written consent.
- Violate our Security Policy or any applicable export or sanctions regulations.
8. Intellectual property
Vision Spy, the Site, and all related software, branding, and documentation are owned by Vision Spy or its licensors. You receive a limited, non-exclusive, non-transferable license to use the service according to your subscription.
You retain ownership of content you upload. You grant Vision Spy a limited license to process uploaded images solely to provide the requested analysis. We do not use your images to train public models without explicit agreement.
9. Third-party links and content
The Site may contain links to third-party websites or services. Vision Spy is not responsible for their content, privacy practices, or availability. Your use of third-party services is at your own risk.
10. Service availability
We strive to maintain reliable service but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with reasonable notice where practicable.
11. Fees and payment
Fees, billing cycles, and payment terms are specified in your order form or service agreement. Prices may be subject to applicable VAT under Spanish tax law. Failure to pay may result in suspension of access.
12. Termination
You may stop using the service at any time subject to your contract. We may suspend or terminate access for breach of these Terms, non-payment, or legal requirement.
Provisions that by nature should survive termination, including liability limitations, intellectual property, indemnity, and governing law, will remain in effect.
13. Warranties and liability
The service is provided "as is" within the limits permitted by applicable law. To the maximum extent allowed under Spanish law, Vision Spy is not liable for indirect, incidental, or consequential damages arising from use of the service or reliance on analysis results.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under mandatory consumer or professional protection rules.
You agree to indemnify Vision Spy against claims arising from your unlawful use of the service or violation of these Terms, except where caused by our wilful misconduct.
14. Applicable law and jurisdiction
These Terms are governed by Spanish law. For business users, the courts of Madrid (Spain) shall have exclusive jurisdiction, without prejudice to mandatory provisions.
If you qualify as a consumer under Spanish legislation, you retain the right to bring proceedings in the courts of your domicile and benefit from mandatory consumer protections.
In accordance with EU Regulation 524/2013, consumers may use the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
